Andrew McCarthy on purging ‘Islamophobia’ from U.S. government vernacular

Former federal prosecutor Andrew McCarthy, who authored The Grand Jihad: How Islam and the Left Sabotage America and who prodigiously writes for the National Review Online and Pajamas Media, spoke yesterday at the National Press Club in D.C. The topic was the Muslim Brotherhood and U.S. policy.

In addition to his prepared remarks, Mr. McCarthy fielded a good many questions. (Full video including Q & A here.) At one point, he was asked about the purging of ‘Islamophobia’ from U.S. government training and vernacular. Here is that exchange:

9/11 Families Alert Congress: President Obama Will Use Thomson Prison Buy to Shut Gitmo

Washington, D.C., July 27, 2012—In a strongly worded letter to House Speaker John Boehner, more than 100 9/11 family members urged Congress to use its appropriations authority to prevent the Obama administration from purchasing Thomson Correctional Facility in Thomson, Ill. The families warned that acquiring the state prison would provide President Obama with a place to move 168 terrorist detainees currently held at Guantanamo Bay, Cuba inside the U.S. homeland, and would put Americans at risk.

“We believe that if Congress clears the way for the Thomson purchase,” the letter stated, “the President will invoke executive authority, defy the wishes of the American people and close Guantanamo Bay detention center without notice, despite bi-partisan opposition from Congress.” They called on members of Congress to join Rep. Frank Wolf, Chairman of the House Appropriations Committee, in rejecting the administration’s request for hundreds of millions of dollars to purchase and retrofit the facility.

In 2010, the Obama administration planned to purchase the Thomson prison and move detainees there but was repeatedly rebuffed by Congress. In 2011, Congress passed bi-partisan legislation barring the use of funds to transfer terrorist detainees into the country for any reason. The families’ letter cited the President’s signing statement on that legislation in which he called the provision “an extreme and risky encroachment on the authority of the executive branch.”

The President’s extensive use of executive authority to nullify acts of Congress has led families of terrorism victims to believe that President Obama will circumvent Congress to fulfill his 2008 campaign promise to close Guantanamo.

“The Obama administration has a track record of trying to end run Congress,” said Debra Burlingame, co-founder of 9/11 Families for a Safe & Strong America. “The Department of Justice tried to sneak two Gitmo detainees into Virginia in May of 2009 despite the fact that both had admitted attending terrorist training camps in Tora Bora, Afghanistan led by terrorist leader Abdul Haq.”

The families’ letter rejected the Obama administration’s claim that the prison project will create an economic boon to the small rural community, calling it a “specious pretense” and “speculative.” The federal government has spent more than $500 million to house terrorist detainees in a state-of-the-art facility at Guantanamo Bay, which includes a court house for detainees being tried under military commissions.

Dear Mr. Speaker:

We have learned that the Obama administration, through the Department of Justice and the Bureau of Prisons, has revived its plan to purchase the Thomson Correctional Facility in Thomson, Illinois. In 2009, we vigorously opposed President Obama’s plan to purchase the Thomson facility in anticipation of closing the detention center at Guantanamo Bay, Cuba and ship nearly 200 terrorist detainees to Illinois. We believed then, and believe now, that bringing hardened terrorists into the U.S. mainland would needlessly put Americans at risk.

We believe that if Congress clears the way for the Thomson purchase the President will invoke executive authority, defy the wishes of the American people, and close Guantanamo Bay detention center without notice despite bi-partisan opposition from Congress. Indeed, while signing a 2011 Defense Authorization bill which included a provision barring the use of funds to transfer Gitmo detainees to the U.S. for any reason, the President signaled his views in a signing statement, calling the prohibition “an extreme and risky encroachment on the authority of the executive branch.”

In an April 4, 2011 letter to the Illinois delegation denying its intention to use the Thomson facility for Guantanamo detainees, the Obama administration nevertheless repeated its position that it considers Thomson sufficiently secure to house detainees and opposes Congressional restrictions on funding it.

Attorney General Eric Holder’s recent testimony before the U.S. Senate, stating that the administration will not seek to move detainees to Thomson, has not reassured us. The President is in no way bound by the Attorney General’s sworn statement. The administration’s practice of using executive authority to nullify Congressional legislation, coupled with its continued insistence that Thomson is a perfectly appropriate place to relocate more than 100 known terrorists, has compelled us to speak out.

We call on Congress to restrain the President in the only way it can under the circumstances — through its appropriations authority. We urge members of Congress to join Representative Frank Wolf, Chairman of the House Appropriations Committee, to stop President Obama from using this ploy to avoid being held accountable to the American people for bringing terrorists to the U.S. In poll after poll, the public has adamantly rejected the plan to close Guantanamo and bring terrorists to the homeland. In December 2009, a Gallup poll found that 68% opposed closing Gitmo and moving terrorists to the U.S. In December 2010, a Rasmussen poll found that 84% of voters worried that closing Gitmo would set dangerous terrorists free.

The Detainee Review Task Force found in its final report that 95% of the entire detainee population as of January 2009 had a connection to Al Qaeda. We have learned from JTF-GTMO officials that the current final group of 168 detainees consists of the most radical leaders, trained operatives, and ideologically dedicated Islamists of the entire original Guantanamo population.

Moving these dangerous individuals to Thomson under the transparently specious pretense of creating a speculative “federal jobs program” while our troops continue to take casualties and sacrifice their lives on the very battlefield where these terrorists were captured is an outrageous insult to the troops and their families.

We reject the extravagant claims that spending hundreds of millions of federal dollars to purchase, refit and operate the facility will rescue the economy of this small, rural community. In fact, studies show that prison enterprises aimed at injecting dollars into failing communities repeatedly fail to live up to expectations. (See http://www.csmonitor.com/Business/2010/0315/Can-a-terror-prison-spark-a-boom) Rural communities like Thomson are sometimes worse off, in part because local economies are displaced, volume suppliers are large companies from far away, and residents don’t have the skills or qualifications to work as prison guards or administrative staff. This would certainly be the case if Thomson were converted to a maximum security facility operated by the U.S. military and unionized federal employees.

The detention facility at Guantanamo Bay is the most secure facility in the world. Located on a remote island, protected by land mines, and guarded by military personnel with state-of-the-art equipment and weapons, no one can come within miles of this secure facility unless the U.S. military wants them to. The U.S. government has spent more than $ 500 million for this facility, which includes a state of the art courtroom for those detainees who are being tried in military commissions.

In light of the above facts, the case for closing Guantanamo, indisputably a superbly-run detention center, can only be reduced to one factor: politics.

As Americans whose loved ones were murdered by the very individuals who are now securely detained at Guantanamo, and as citizens who have watched more than 7,000 of our valiant armed forces sacrifice their lives in battle since that dark Tuesday morning almost eleven years ago, we regard the politics behind the effort to close Gitmo as nothing more than a cynical maneuver aimed at fulfilling a 2008 campaign promise.

Mr. Speaker, we urge you and your colleagues on both sides of the aisle to stand firm with the American people, and prevent this lawless and irresponsible plan from going forward.

9/11 Families to Govs. Cuomo and Christie: the Port Authority’s conduct is a betrayal of those who died on 9/11

Dear Governor Christie and Governor Cuomo:

Over the past several months, we have watched with growing concern as the National September 11 Memorial Museum has become the focus of a public dispute over funding. We are deeply disappointed that the Port Authority of New York and New Jersey, the government agency over which you are jointly charged with oversight and control, has brought this important historic project to a standstill. As 9/11 family members who have been personally involved in the development of the Memorial and Museum, we refuse to stand by while the individuals you appointed — and whose actions you have the power to veto — allow this vital project to founder.

It is bitterly ironic and cynical in the extreme for the governors of New York and New Jersey — states which lost the most people on 9/11 — to express concern for the “long-term stability” of the 9/11 Memorial Foundation even as your appointees at the Port Authority seek to raid the foundation’s charitable coffers, essentially nullifying by several times over the amount of federal assistance for which you recently voiced your support.

The Memorial and Museum Foundation has raised more than $435 million in private donations from 900,000 mostly small donors. To date, the Foundation has achieved every fund raising goal, has met every contractual obligation, and has diligently worked in good faith to fulfill its dual obligations to the memory of our loved ones and to the public trust.

We believe that the Port Authority is now engaged in a dishonest and dishonorable effort to exploit the Foundation’s successful and disciplined efforts in order to offset its own reckless and irresponsible fiscal mismanagement. In short, the PA is seeking to use the public’s heart-felt support of the 9/11 memorial and museum as an easy source of revenue to help pay for its own oversized, under-budgeted, poorly-managed capital projects (see the $3.5 billion PATH station lobby, serving a mere 50,000 commuters, originally estimated to cost $1.8 billion; see also, the PA’s $25 billion capital plans — scaled back from $33 billion after public outrage.) That is despicable.

The Memorial Foundation has repeatedly refuted the Port Authority’s bald assertion that it is owed $157 million (the PA has inexplicably doubled the amount to $300 million in some press reports). Equally troubling are unsupported reports that the cost of the Memorial and Museum has soared to $1.4 billion. According to the foundation, none of this is true. It maintains that the Memorial and Museum costs owed to Port Authority were capped at $530 million in a properly executed 2006 contract. In that agreement, the Port Authority promised to deliver both the memorial and museum in 2009. It is the Port Authority which has delayed, dissembled and now disrupted this vitally important historic project.

Ten years ago, we witnessed devoted recovery workers clear 1.8 billion tons of twisted steel and concrete, putting their lives on hold, focusing only on what they perceived was their solemn duty to their fellow human beings. It took these honorable men and women nine months to bring order out of chaos.

It has now been nine months since the Port Authority sent workers off the site, creating new chaos out of order. The museum opening, slated for this September, has been indefinitely delayed. It will not open before 2013. Every month of Port Authority delay ensures that costs continue to rise.

Governor Christie and Governor Cuomo, the Port Authority’s conduct is a betrayal of those who died on 9/11. It is a betrayal of the thousands who risked everything to honor them, and it is a betrayal of the growing number of children for whom “9/11” is not a first-hand memory.

We ask that you direct the Port Authority to honor their contract with the Foundation, immediately restart construction of the National September 11 Memorial Museum, and finish the job.

The Port Authority of New York and New Jersey demands more money from a charitable foundation before it will finish construction.

Wednesday, May 30 marks 10 years since the recovery operation at the World Trade Center site officially ended. On that day, the “Last Column,” a 37-foot, 58-ton section of structural steel, was draped with an American flag and escorted from the site by an honor guard in a solemn ceremony that left grown men weeping.

The beam had become a sacred totem after the remains of three New York City firefighters from Squad 41 were found near its base. Recovery workers covered it with memorials to the dead: photographs, decals and hand-scrawled tributes: “FDNY 343,” “PAPD 37,” “NYPD 23,” the numbers of those killed from the city’s first responder departments.

During the recovery operation, ironworkers, heavy-equipment operators and others in the construction trades removed 1.8 million tons of twisted steel and concrete, heaped seven stories high; the Last Column’s silent, enduring presence was a solemn tribute to the best of humanity. It was brought back to the World Trade Center site in August 2009, where it will be viewed by millions when the National September 11 Memorial Museum opens.

Yet the museum opening, which was on track for Sept. 11, 2012, has now been delayed indefinitely. The final phase of construction ground to a halt last year in a public dispute over funding between the builder, the Port Authority of New York and New Jersey, and the nonprofit foundation that raised the money for the project. Lamentably, the two governors involved in this drama, New Jersey’s Chris Christie and New York’s Andrew Cuomo, have done nothing to stop the Port Authority’s shameless gambit to squeeze more money out of a charity to which 900,000 mostly small donors have contributed.

The Port Authority of New York and New Jersey is the bi-state agency that owns the land and lobbied heavily for the federally funded, multibillion-dollar job of rebuilding the 16-acre site. It claims that the National September 11 Memorial & Museum Foundation owes the agency $157 million more than the $530 million cost cap the agency itself agreed to in 2006. The Port Authority has not publicly stated any basis as to why it is owed additional money.

The Port Authority, run by a powerful group of politically connected bureaucrats, has long been accused of cronyism, mismanagement and waste. Last December, Gov. Christie announced that he was initiating a $2 million independent audit of the agency’s accounting. This came in the wake of a public outcry over the PA’s unilateral decision in August 2011 to raise bridge and tunnel tolls by 50%.

As Sen. Frank Lautenberg (D., N.J.) said, “There is something wrong when it costs $12 to cross a bridge in America.” He has joined Rep. Michael Grimm (R., N.Y.) in calling for federal oversight of the Authority “to make sure toll revenue is being used appropriately, and not going to fund excessive salaries or political patronage jobs.”

There are grounds for the charge. In November 2011, the Record newspaper in Bergen County, N.J., reported on the basis of public records that the Port Authority was giving 100 of its highest-paid employees secret bonuses totaling $2 million a year, beginning in 2008, at the height of the recession.

And in July, New York State Comptroller Thomas DiNapoli issued a scathing report revealing that the Port Authority paid $85 million in overtime costs to 5,360 of its 6,900 employees in 2010. Three hundred and forty-seven employees received more than 50% of their base salary in overtime. According to the report, in 2009 the agency spent $52 million on overtime, and the basis for the top overtime earners could not be supported with written records.

Mr. DiNapoli also noted that the Port Authority authorized $4.38 billion in service contracts from 2006 to 2009. In a random sample of 75 of those contracts valued at $1.3 billion, according to the report, the agency lacked written support for 57 of them, valued at $1.18 billion. The Port Authority’s in-your-face response to Mr. DiNapoli’s report was that the overtime business model works just fine.

Perhaps the most trenchant description of the Port Authority’s method of doing business was outlined in an Oct. 19, 2011, op-ed in the New York Post by the PA’s former executive director (1995-97), George J. Marlin. In an open letter of advice to Gov. Cuomo’s newly appointed executive director, Patrick Foye, Mr. Marlin urged Mr. Foye to reject Port Authority bureaucrats’ cost estimates and construction timetables on new projects. He said they are deliberately lowballed to get approval.

Once construction starts and millions are spent, Mr. Marlin said, subsequent cost “overruns” are the norm. He called the PATH train terminal at Ground Zero a “perfect example of PA staff conniving.” Originally estimated to cost $1.8 billion in federal money, the 800,000 square foot terminal has ballooned to an astronomical $3.4 billion and rising.

In January of this year, Gov. Cuomo raised the specter of a lawsuit by the Port Authority against the Memorial & Museum Foundation regarding its $157 million claim. The governor surely knows that litigating the dispute in court could entail years of delay, jacking up construction costs in excess of the amount that the agency is demanding.

In the meantime, millions of Americans would have to wait while a government agency pursued its extortionate demand through the courts. And this from the same governor who issued a commemorative “We Remember” flag to be flown statewide for the 10th anniversary of 9/11.

Yet this is the Port Authority way: Abrogate the contract, shut down work, then make an offer the other side can’t refuse. The foundation’s CEO, Joe Daniels, wants to resolve the dispute in a manner that moves the project forward. The 2006 contract provides for fast-track mediation. But Mr. Daniels told me that a Port Authority board member warned him in a heated telephone conversation last October, “Go ahead and do it [request mediation] that way and we’ll see how long it takes to get your museum built.”

The Port Authority should be reminded that this isn’t Mr. Daniels’s museum. It belongs to the public, funded in part by federal tax dollars appropriated by Congress to show the world that America isn’t beaten. It belongs to private donors who have supported the project because they believe that future generations should be taught about this attack on the country, and how it changed the world.

Govs. Christie and Cuomo have made significant strides confronting fiscal challenges in their respective states. It is time for them to exert leadership and direct their political appointees to fulfill the PA’s contractual obligations, restore the public trust and complete the construction of this vital national treasure.

Yesterday, on Freedom Radio, I interviewed Charles “Cully” Stimson of the Heritage Foundation about Saturday’s arraignment at Guantanamo Bay of 9/11 mastermind Khalid Sheikh Mohammed and what we are likely to see as the trial gets underway:

“The defendants are very, very ably represented and the government has put forward a good team, and that’s what you want. You want a clash of the titans to test and push the system. You have a good judge, a very experienced judge. … Those few extremists who criticize commissions should withhold judgment. They won’t, of course, as they see the commissions process unfold.”

Debra Burlingame: The TSA is inept; We Must Assure Our Skies Are Both Safe and Friendly

This was first published on April 20, 2012 as my Letter to the Editor of the Wall Street Journal.

Kip Hawley, the Transportation Security Administration’s former administrator, fails to acknowledge a November 2011 congressional report documenting that the TSA has become a bloated, 65,000-person bureaucracy larger than the departments of Labor, Energy, Education, Housing and Urban Development, and State, combined (”Why Airport Security Is Broken—And How to Fix It,” Review, April 14). It has spent $57 billion since 2002, $2.7 billion of which was spent on training. Yet half of the people it has hired and trained have left the agency. With the highest attrition rate among the federal work force, the TSA has resorted to placing employment ads in the Washington, D.C., area on pizza boxes and over the pumps at discount gas stations.

The report notes that 25,000 security breaches have taken place at U.S. airports since 9/11. According to the Government Accountability Office, 17 known terrorists have flown on U.S. carriers on 24 occasions, including traveling through eight airports where behavior-detection officers are deployed—a program that has spent $800 million since 2007 and will cost $1.2 billion more over the next five years. While not one terrorist has been spotted, the TSA has justified the expense by citing the discovery of passengers involved in common crimes, such as credit-card fraud or drug smuggling, resulting in mission creep and the pervasive sense that anyone who approaches the check point is a potential suspect.

After the Christmas Day bombing attempt in 2009, the take-away lesson for the TSA wasn’t that it should be looking for dangerous people instead of dangerous objects. Instead, the agency doubled down, ordering up more invasive body scanners whose manufacturers have reluctantly admitted can’t detect low-density powder hidden behind male genitals. The virtual strip-search photos put out by the TSA depict captured images of hard metal objects, guns and knives, not explosives.

For me, the sad reality is that the TSA has succeeded in accomplishing what Osama bin Laden couldn’t. I now dread the airport. I view the TSA as an inept government agency, which makes complicity in my own humiliation the price I must pay to fly.

Justice coming for 9/11; KSM and cohorts to be arraigned May 5 at Guantanamo

Self-admitted 9/11 mastermind Khalid Sheikh Mohammed and his four senior cohorts will be arraigned May 5 at Guantanamo. The five will be tried together on 8 counts, 5 of which are capital crimes. The New York Post reports:

The US military announced last week that the five would be tried jointly by military commission on charges including terrorism, hijacking aircraft and murder in violation of the law of war for their role in the 2001 terror attacks that left nearly 3,000 dead on US soil.

Defense attorneys had sought to avoid charges that carried the death penalty and wanted the five to face separate trials.

The five accused terrorists face the death penalty if convicted.

Credentialed 9/11 family members and those injured in the attacks will be able to view the proceedings at four secure sites. An unofficial transcript will be made available each day and I will report here throughout the trial. Update: In addition, 5 family members will be selected each week, via a lottery, to attend the trial at Guantanamo.

Muslim leaders, Congressman King, 9/11 family members and 1st responders support NYPD counter-terrorism efforts

Muslim leaders of the American Islamic Leadership Coalition (AILC) rallied this morning at 1 Police Plaza in New York City in support of NYPD counter-terrorism efforts. They were joined by Congressman Peter King, 9/11 family members, first responders, and concerned citizens.

The group spoke this morning at a news conference outside police headquarters organized by the American Islamic Leadership Coalition. They say the police department’s counter-terrorism efforts — including the monitoring of Muslim communities in and around the city and at area colleges — is necessary to keep New Yorkers safe.

“The NYPD is carrying out effective surveillance. If they were not doing what they are doing to me they would negligent and remiss in their duties,” King said. “They are doing surveillance at mosques which are public spaces, it’s fine. I have nothing to hide. I have no problem with a police officer monitoring my mosque praying right next to me … does not bother me. As a Muslim American I have nothing to hide,” said Samir Abdelkhalek of the Muslim Liberty Project. “It’s rather denial to not recognize we have a responsibility to root out that radicalization,” said Dr. Zuhdi Jaffer of the Islamic Forum for Democracy.

The New York Daily News added:

The rally, held outside NYPD headquarters in lower Manhattan, was sponsored by the American Islamic Forum For Democracy. The group’s founder, Dr. Zuhdi Jasser, narrated “The Third Jihad,’’ a controversial documentary that Police Commissioner Raymond Kelly was interviewed for, but later deemed “inflammatory.”

Jasser said he wished Kelly “had defended that,’’ but he said the bigger issue is that the department’s surveillance operations were appropriate because of the ongoing threat of attacks.

“We are not here to criticize the NYPD,’’ Jasser said. “But rather to thank them for doing the monitoring of extremists that Muslims should be doing.”
